hereinafter referred to as the provider, are bound be the contract.
2. Subject of the contract
This contract regulates the sale of services from the areas of coaching and seminars of the provider. For details of the respective offers, please refer to the product description on the offer pages.
3. Conclusion of the contract
The contract is concluded in electronic business transactions using the online form or other means of distance communication such as telephone and e-mail. The order process with the online form for the conclusion of the contract includes the following steps:
- Selection of the offer
- Filling out an order form
- Press the button ‘Book now’.
- Confirmation e-mail that the booking has been received and with details of the payment method.
- Transfer of the amount to the provided bank account.
- After receipt of the amount a further confirmation mail and appointment arrangement follows.
In addition to the online form, orders can also be placed via remote means of communication (telephone/e-mail), whereby the order process comprises the following steps to conclude the contract:
- Calling / sending the order mail
- Confirmation mail that order has been received
- Transfer of the amount to the provided bank account.
- After receipt of the amount a further confirmation mail and appointment arrangement follows.
By sending an order confirmation the contract is concluded. The automatically generated and sent order confirmation does not represent a corresponding legally binding declaration. The contract is also concluded through the delivery of the service.
4. Offers, prices and fees
The offers are subject to change without notice. We reserve the right to make changes.
For all offers, the fees published on the website and/or listed in the event advertisement will be charged.
All prices are final prices and include 19% VAT.
5. Terms of payment
The customer transfers the fees in advance to a bank account provided to him.
After receipt on an invoice, the invoice amount must be transferred in advance to the account provided on the invoice. The invoice contains all the details for the transfer. The Customer is obliged to pay or transfer the invoiced amount to the provided account within 30 days of receipt of the invoice. Payment is due without deduction from the invoice date. The customer is in arrears only after a receiving a payment reminder.
6. Arranging appointments
Dates for coaching and mentoring sessions will be arranged upon receipt of payment.
A place at an event is only secured upon receipt of the deposit or seminar fee.
The time and place of a coaching session will be mutually agreed between the coach and the client. This can be done by e-mail or telephone.
Time and place of the events will be determined by the coach and accepted by the client. The registration for events takes place exclusively in writing, by e-mail, via the contact form or via the respective booking form.
Agreed dates are binding. The customer agrees to turn up on time on all arranged appointments.
7. Cancellation of a coaching appointment or event by the client
Cancellation of Coaching- and Mentoring Appointment Cancellation
Cancellation up to 30 days before the agreed date:
the fees already paid will be refunded minus €20 administration fee.
For cancellations within 30 days to 7 days 50% of the fee will be refunded.
In case of cancellation from 7 days before the agreed date, the full fee will be retained.
Date Changes of Coaching and Mentoring
A postponement of a coaching date is possible up to 2 working days before the date at the latest and free of charge until then. Thereafter, 50% of the fee for the agreed time will be charged.
In the event of a postponement of the appointment on the day of the coaching as well as in the event of non-appearance, the full fee will be due as a cancellation fee.
Events:
Cancellation up to 30 days before the start of the event:
The seminar fees are fully transferable, fees already paid will be refunded less €20 handling fee.
Cancellation within 30 days to 10 days before the start of the event:
The deposit will be retained and is not transferable. All other seminar fees will be refunded.
Cancellation from 10 days before the start of the seminar:
The full seminar fee must be paid, unless another person suitable for the group can join.
8. Cancellation of a coaching appointment or event by the coach
In the event that the coach has to cancel or postpone a coaching appointment for urgent reasons, the client will be informed as soon as possible in order to offer an alternative appointment. Further claims, in particular claims for damages, do not exist.
In the event that the required number of participants of an event is not reached or an event has to be cancelled for other reasons, the customer will be informed as soon as possible and the already paid participation fee will be refunded. There are no further claims beyond this.
9. Copyright
Offers, tenders, coaching and consulting concepts, personally created CDs, MP3 files, e-books, online course documents and other documents are protected by copyright.
All documents, videos, audios, PDFs, e-books, etc. handed over or made accessible to the customer are intended exclusively for personal use. The customer is not permitted to reproduce the documents or parts thereof and/or to make them accessible to third parties. A publication – also in extracts – is forbidden and can be prosecuted.
10. Liability
The coach undertakes to perform all agreed services carefully to the best of her knowledge and belief. There is no guarantee for success in providing the service in coaching or at events/training. Liability is excluded.
The customer confirms with the date agreement and/or registration to events, to act independently and to release the service provider from all liability claims. The customer acknowledges to be fully responsible for his/her physical and mental health and to pay for any damages caused.
11. Confidentiality
The Coach pledges to maintain confidentiality about all professional, operational and private matters of the client that become known within the scope of the service, even after the termination of the contract.
12. Language, place of jurisdiction and applicable law
The contract can be drawn up in German or English. The further execution of the contractual relationship shall take place in German or English. The law of the Federal Republic of Germany applies exclusively. This only applies to consumers insofar as no legal provisions of the state in which the customer has his residence or habitual abode are restricted. The place of jurisdiction for disputes with customers who are not consumers, legal entities under public law or special funds under public law is the registered office of the provider.
13. Severability clause
The invalidity of a provision of these Terms and Conditions shall not affect the validity of the other provisions.
